Specific Details Ian O'Mara and Joe Beashel met with Department of Finance officials on 10 August 2023 in relation to the consultation on the national discretions open to Ireland in the new Markets in Crypto Assets Regulation (MiCA). On 13 September 2023 Matheson submitted a Consultation Paper to the Department of Finance as part of a submission to the MiCA public consultation.

Intended results To bring to the attention of the Department of Finance the regulatory regime of the Central Bank of Ireland in relation to E-Money Institutions and Virtual Asset Service Providers up to this point. Of particular relevance was group structures employing dual structures of EMI and VASP entities and how this could interrelate with the transitional period under MiCA.

Submission (1)

On 13 September 2023, Matheson submitted a Consultation Paper, prepared by Ian O'Mara and Joe Beashel, to the Department of Finance as part of a submission to the MiCA public consultation. The paper sought feedback on four discretions: Article 88(3): Public disclosure of inside information; Article 111(1): Administrative penalties and other administrative measures; Article 143(3): MiCA transition period and Article 143 (6): Simplified authorisation procedure.
